Registrant RELEASE FORM
Small Business Council, Inc. (the “Small Business Council”) will be recording and live streaming all presentations at the Small Business FestivalTM event to be held May 2nd – 6th (the “Event”). Beyond the day of the Event, Small Business Council will share the great ideas discussed at the Event by making the presentations available to additional audiences.
As a registrant and attendee at the Event, the following Registration and Credentials Terms and Conditions (“Terms”) apply to you and any party you are registering for participation in the Event (“Participant”), and such Participant’s registration, attendance, participation, enrollment, and/or application for involvement in the Event, including but not limited to your purchase and/or possession of any Event entry material, such as badges, wristbands, tickets, passes, and giveaways (“Credentials”). By clicking “accept” below and/or by obtaining your Credentials you agree to these Terms.
Refund Policy. No refunds under any circumstances. Any and all payments made to the Small Business Council are not refundable for any reason, including, but not limited to, failure to use the Event Credentials due to illness, acts of God, travel-related problems, acts of terrorism, loss of employment, changes to the Event schedule (including speaker cancelation), and/or duplicate purchase.
Unused and Lost Credentials. Unused Credentials cannot be credited to future years or events hosted by the Small Business Council. It is at the sole discretion of the Small Business Council to replace lost or stolen Credentials. In the event Credentials are lost or stolen, new Credentials may need to be purchased for a Participant’s continued access to venues and activities related to the Event.
Revocation Policy. The Small Business Council may, in its sole discretion and at any time determined by the Small Business Council, cancel, revoke, or refuse from any individual or company the following: Credentials, entry to a premise or venue associated with the Event, or partition in the Event. The Small Business Council will not be responsible for any penalty, fee, loss, or expense that might result from such action. The Small Business Council will not issue refunds for Credentials that have been revoked.
Recording and Image Policy. Photographs, video, and/or audio recordings captured at or during the Event by the Small Business Council, or others on behalf of the Small Business Council, may include a Participant’s image, name, voice and/or likeness. By attending and/or participating in the Event, each Participant hereby grants the Small Business Council permission to use the Participant’s photograph, image, likeness, voice and statements for any purpose, including but not limited to commercial purposes, without compensation or credit to the Participant, in any and all media now known or hereafter devised.
Responsibly Policy. Event Participants are expected to behave and dress responsibly and to treat each other, the presenters, organizers, staff, and the public community with respect and decency. The Small Business Council reserves the right, without refund, to revoke the Credentials of Participants whose conduct is deemed inappropriate, disorderly, or offensive by the Small Business Council or the local authorities.

Session Policy. The Small Business Council is proud to provide a significant number of free community sessions, as part of the Event. Admittance to any free community session may require pre-registration and is subject to venue capacity. The Small Business Council cannot guarantee admission to any particularly session and pre-registration does not necessarily assure admission to the free community session.
Risk Policy. Participants assume all risk of damages, property loss, and personal injury which may occur by participating in the Events.
Limitations of Liability. IN NO EVENT SHALL The Small Business Council BE LIABLE TO ANY PARTICIPANTS, OR ANY OTHER PERSON OR ENTITY FOR ANY PERSONAL INJURY OR DAMAGES TO PROPERTY, DAMAGES FOR LOSS OF BUSINESS PROFITS OR OTHER PECUNIARY LOSS, INCLUDING ANY DIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE OR SIMILAR DAMAGES, ARISING OUT OF ANY PARTICIPANT’S PARTICIPATION IN THE EVENT.
Disclaimer of Warranties. EXCEPT AS MAY BE EXPRESSLY SET FORTH IN THESE TERMS, PARTICIPANT’S PARTICIPATION IN THE EVENT, AND ALL SERVICES AND PRODUCTS PROVIDED IN CONNECTION WITH THE EVENT, ARE PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, AND NO OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR OTHERWISE, ARE MADE WITH RESPECT TO THE SAME, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR SAFETY, OR ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING. the Small Business Council EXPRESSLY DISCLAIMS ANY WARRANTIES NOT EXPRESSLY STATED HEREIN.
Indemnification. Each Participant agrees to indemnify, defend, and hold the Small Business Council and its officers, employees, volunteers, and representatives harmless from and against any and all claims, demands and all other liabilities, including, but not limited to, costs and attorneys’ fees, made by any third party arising out of or in connection with each Participant’s use of the registration(s) or Credentials, or any Participant’s violation of the Terms.
Governing Law. The Terms will be governed by the laws of the State of Texas, without regard to its principles of conflicts of laws. Each Participant and Small Business Council hereby irrevocably submit to the exclusive jurisdiction of the United States federal and state courts located in Austin, Texas and agrees that any such court will be the proper forum for the determination of any dispute arising hereunder.
